Terms and conditions

These terms and conditions pertain to our Drainage & Groundwork services. Please carefully review this document as it contains all the necessary information regarding the terms and conditions under which we will deal with each other.

  1. Our intention is to include all the terms of the agreement between us in this document, including details of the services and any goods or materials we will provide. If you have any questions or do not agree with any of the provisions in these terms and conditions, please inform us.
  1. Smarter Drainage employs its own staff and qualified independent contractors authorised by Smarter Drainage Limited to provide you a service.
  1. Independent contractors do not have the authority to assume liability on behalf of or act as agents for Smarter Drainage Ltd or any of their licensees.
  1. Quotations provided by us are valid for twenty-eight days from the date they are given. We reserve the right to modify or withdraw any quotation before it is accepted by you.
  1. We will make every effort to complete the work and provide the goods and materials for the quoted amount. However, unforeseen circumstances may lead to additional costs beyond the quoted amount. In such cases, we will promptly inform you, explain the reasons for the additional costs, and request your acceptance of an amended quote to cover the additional expenses.
  1. The price you are required to pay is the Total Due amount stated in the quotation. Unless stated otherwise, the price includes VAT at the prevailing rate.
  1. For Domestic Customers: Upon completion of the work, you will receive an invoice with the Total Due amount, which must be paid immediately. Failure to make immediate payment will result in an administration charge of £5, and interest will accrue on the outstanding amount at the prevailing rate plus 5% per annum until full payment is received.

7.1 For Commercial Customers: Upon completion of the work, you will receive an invoice with the Total Due amount, which must be paid within 28 days from the date of the invoice. Failure to make payment within this time will result in an administration charge of £5, and interest will accrue on the outstanding amount at the prevailing rate plus 5% per annum until full payment is received.

  1. An administration charge of £10 is payable for each dishonoured cheque presented for payment by your bank, regardless of the reason.
  1. We will carry out work during our normal business hours, which are from 8am to 6pm, Monday to Friday. We may be able to work outside these hours for an additional fee.
  1. We will not be liable for any loss or damage to your property, including cleaning, or any other type of loss, unless we are responsible for it. If we need to access your property for repairs, we will fill any holes and level the surface, but we will not replace the original surface or structure. Any redecoration or repair required after our work is your responsibility, unless we have been negligent.
  1. It is your responsibility to inform us of any potential hazards or dangers that may exist while we carry out work on your property. Additionally, you must ensure that we have clear access to relevant drains and covers, as well as a supply of mains electricity and water. If your failure to provide clear access, electricity, or water results in additional work or expenses for us, we may charge you accordingly.
  1. We provide a guarantee for all parts and labour for a period of 90 days from the completion of the work. However, please note that our guarantee does not cover faults caused by misuse, neglect, or normal wear and tear. This guarantee does not affect your legal rights, including those outlined in the Consumer Rights Act 2015, if applicable. For information about your rights, you can consult Citizens Advice or Trading Standards.
  1. We will not be held responsible for any failure to fulfil our obligations under this agreement due to circumstances beyond our control.
  1. If you are a tenant, you must obtain your landlord’s permission for us to carry out the work. If the property is a listed building, you may also need planning permission. In either case, it is your responsibility to obtain any necessary permissions for the work.

  2. Notice of Your Right to Cancel: You have a 14-day cooling-off period starting from the date you accept our quote or, if we have ordered parts for the job, starting from the date they arrive. During this period, you can cancel the agreement. However, if we have already started work and you choose to cancel, you will be charged for any work that has been completed.
